Abit of back ground info: on the Mercedes forum, i stuck my nose into a thread where i got sick of reading Powerchips personal issue against another member.

A couple of days ago i listed my headers for sale, as Scotty is going to make me new ones. Powerchip has an issue with my add and claims and is now sending me a letter from his lawyer, apparently. So i must of really pissed him off.
Powerchips problem: My headers are not Genuine Car Graphic headers and i should stop calling them by that name.
Me: i said get lost, to me they are Car Graphic headers. I admit they maybe copies and not genuine. I listed where i bought them from and what i was told. I told him to take his issue up with them. Instead i got this from him

Dear Sir,

My name is Wayne Besanko, I am the Managing Director of Powerchip Australia Pty Ltd.

It has been brought to my attention that you have offered for sale an exhaust product that you refer to as 'Cargraphic'.

As you are aware, our company has advised that your description of the product you are selling as 'Cargraphic' is a breach of Section 52 of the Trade Practices Act (Cth), in addition to other issues that will be raised in the communication that will be sent to you shortly.

We have requested our lawyer act for our Company in relation to this matter, and we request the following of you to enable our lawyer to communicate with you.

Your name (as it appears in full on your passport)
Your address for the service of documents

If you wish, you can simply provide your name, and the address of the lawyer that you have instructed to act on your behalf if you do not wish to provide your residential or postal address.

This matter is urgent, and any delay in replying will be considered should a costs order be awarded against you.

We also view this communication and the matter as private and confidential, and if you disclose this communication to a third party, we will ask that your actions be considered when costs are determined.

I suggest that you cease making further statements in relation to the exhaust product you had referred to as 'cargraphic' until you have read the communication from our lawyer and have obtained legal advice in relation to it.

This communication is without prejudice to rights that have accrued and continue to accrue. Powerchip reserves its rights in relation to this matter.

section 52 refers to deceptive/misleading conduct

if he wants to sue you fine, dont help him, dont give him your name or anything, let him try figure it out himself, chances are they wont be able to. they will have to contact the forum, who if was this forum would tell them to eat a dick, but lets say that forum gives up the info, then they will have your email address of registration, and maybe a name (if u put a real one in). once they got that they will then have to find you, again very hard on a civil matter. they will get your IP but no ISP is going to give up your details without a court order, witch once again wouldnt happen

my recommendation is first things first login to your user control panel on that forum and change your name away from your real name, something super generic like john smith, the admin of the forum wont be able to see the previous name so your fine there. if you use a work email, ie yourname@youwork.com go register and change it to a hotmail, ie, chunkylover69@hotmail.com.. that should pretty much cluster fuck them. might wanna do a scan real quick and make sure you haven’t put your name and or phone number in any of your posts on that forum. Or anywhere else they can google, also might wanna move this topic to offtopic or else its going to light up on google

I am under no obligation to provide you with any information, if you wish to take action against me i would advise you to tell your council to start the long and expensive task of figuring out who i am and then taking me to court.

Being a lawyer my costs in such a matter will be a lot less than yours, by my rough calculation approximately 100% less than yours.

I openly encourage you to waste your money with your council, they will appreciate the business, Christmas is coming, and we all have beach houses that need renovating, salt damage is a killer.

Section 52 is going to be a very very hard one to prove there. You would be a lot smarter to go after the manufacturer of these alleged trademark infringing products.

In future i advice you to keep your scary letters for the commodore drivers. but if it makes you feel any better i was very scared for a short while, but then i realised it was gas.
