It could be a fake email, ive only got iphone internet and email access, so i can not check the validity of the email. But it is coming up with his name as the sender as per previous emails

I reckon it's a fake - I've been getting a couple from the Aus Tax Office, telling me that they made a mistake and there's a refund of a few hundred dollars waiting for me. The email return address and URL's I can't fault (with my relatively limited knowledge of such things) so it really does look legit.
The trouble is that it's for my 2010 tax return, which I haven't submitted yet so it's fake.
My point being that it doesn't seem too difficult to fake such things fairly convincingly,

If someone is using Outlook you can bring up the 'from' field and type in someone else's email address and that'll be the return path...well, we can do that internally at work; it might not work externally, i've never tried it.

When you get home, view the internet headers and get one of the techie geeks on here to see if it looks legit.

In the criminal court it doesnt mean shit if you put "without prejudice" on the header (or anywhere), so yeah his email would be admissible - plus if it is anything like it is in QLD for DVO's, there are no rules of evidence in these types of proceedings which means it's open slather insofar as evidence is concerned.
