So for both parties under the age of 16, there is no such thing as consensual sex (legally) and if there was to be charges laid, in the US they have what is called statutory rape (sex with a minor) which can be applied in either direction (ie the male can have instigated the sex or the female can have done it so either of them could be "guilty" of the offence). That would be pretty much true here in Aus too, but I'm not sure of what the names of the offences are and whether there are many occasions where they have been brought to bear. There are certainly enough underage pregnancies where the father is also underage that don't seem to have anyone get in trouble with the law.
