    The question was a mate of mine gave a love tap to a guy and due to the minimal damage the repair was going to be done out of insurance and the guy had not contacted him, and was wondering about the statute of limitations

            To the OP, dont ignore it.

            If it is a Statement of Claim then proceedings have been issued and there is a deadline to lodge a defence. If you fail to lodge a defence then judgement can be awarded in th plaintiff's favour. You will then have more curry munchers harrassing you for payment.

            Do this - there should be a template form for lodging a defence. Put your facts as clearly as possible in this form, and attach your pictures to support your case. Send/fax your defence before the deadline. Chances are that will be the end of the matter at that stage.

              If you were insured at the time give them a call and tell them to sort it out for you.

              If you don't you may have Judgment entered against you which is 28 days in NSW.

                            Did that...they want me to pay the excess first ($1000) then they will chase it....

                            If I loose the case then I will have "made a claim" which isnt cool as far as insurance goes for the next 5 years.

                            Ive decided to defend myself...posted the defence paperwork yesterday.

                                Get your insurance company to do the leg work, remind them of this little clause that would be in the wording, normally along the lines of:
                                An excess will not apply if
                                • the incident was not the fault of the driver of your vehicle, and we are provided with the contact details of the person who caused the incident, including their name, current residential address and vehicle registration, and who they are insured with


                                Surely there are better things to do than to sit in a court room for a half a day - although this can sometimes be entertaining on who is getting tried for what..
