he was not happy - but admitted it... and did the rebuild...

Subaru did and may still come to Track days and record rego numbers of late WRX at the event to exclude them from warranty. Guys took plates of to make it hard for them.

Most of the Road Reg cars running at the Mallala Time Attack events now run minus reg plates.

Do you have public liability insurance for damage arising from faulty workmanship? Did you sublet the tuning or did he take it to the tuner himself?

If he took it to the tuner himself then he should approach the tuner, if it is a sublet of yours then you will be the liable party but your insurance should be able to recover from the tuner if they feel they have enough evidence.

You would be surprised what happens to these types of incidents when the they go to court, a court would not give a fuck about your "as soon as it leaves the concrete" warranty. If you are supplying a good or service then it needs to meet the reasonable expectations of the owner.
