At fault "accident" and trying to be taken for a ride - recourse?

      Yeah, just lodge the claim through your insurance company and explain the situation, provide a clear description of the damage to your car and photos if you want.

      Explain that there was no visible damage on the vehicle when they left the scene and that you would like the assessor to confirm that the damage they are claiming for is consistent with the damage on your vehicle and the speed/description of the accident.

      The assessor will assess the other vehicle and determine a "Fair and Reasonable" cost of repair

      Ask that you be informed that once the F&R estimate is worked out, that way you have the option to withdraw the claim if it is under your excess.

          Sounds a bit like a customer I had once..

          She had a '06 Getz with hail damage all over and ran up the back of a Camry pulling off from the lights. She was doing about 20km/h on impact so it bent the bonnet down a touch and cracked the front bar on the reo.
          Being Sydney, the Camry driver was a curry munching cunt, so he gets out of the car screaming he's got whiplash and he's in pain. When he realises nobody is going to buy it he heads around to the N/S/R Qtr which was demolished by a pole or possibly another car a long, long time ago. He starts carrying on the this poor girl did that damage. She has no proof to say otherwise (but obviously her damage and his damage don't line up), so to a AAMI claim they went.
          She comes into our shop one day with curry muncher and gets a quote done on her car (no insurance on her part) while he's on his way. He turns up and points out the rear bar damage (that she actually did) and the quarter damage (that she didn't do) and says it's all for the insurance claim. My workmate quotes the rear bar only and tells him to piss off because there's no way her car did all that.
          Now being AAMI, he had to go to their assessment centre in Bella Vista. Assessors checked it out and rang us about the "incomplete" quote. Over the course of about 4 or 5 phone calls with different AAMI idiots and sending each of them photos of her car, they eventually realise something is up and they go to investigate.
          In the meantime, girl at fault realises she can't afford the repairs and she's moving to WA anyway, so she sells us the car for fuck all and pisses off to WA. We put it into service as a loan car.
          Fast forward about 6 months and AAMI call again about this because they're now chasing her for damages INCLUDING the quarter panel, but can't track her down. I'm glad they couldn't, because she'd be getting screwed hard if she hadn't have moved.

          Moral to the story: have insurance.

            A few years back I was behind an old couple at a set of lights and as the light turned green we both slowly moved off. I was in the Transporter so it's not like I could launch it, but as she made drove off the old dear thought she would hit the brake instead of the accelerator after about 10 feet. I was onto the brakes straight away and pulled up 1 centimetre too late. Just gave the gold Camry a love touch. The old dear's hubby gets out, walks around to the back of the car and says "what are you going to do about my damage?" The damage consisted of a mark, not a scratch, a mark in the plastic bumper caused by the plastic cover of my number plate ( which had cracked, but not broken ) as it collided at warp factor nine with their car.

            We swapped details and left.

            A month later I get a phonecall from a Suncorp claims person letting me know that the other car's owners have lodged a claim for a new rear bar and that they were injured.

            I advised the Suncorp rep I was insured with Suncorp also and told him that my damage amounted to a cracked number plate cover, but no neck injury, he just laughed and said " well that's the end of that claim ".

              And this why after having a Navara flatten the back of my Festiva to the point of buckling the roof, me bending the drivers seat during the impact and being unable to get a proper quote because it's unsafe to drive and panel beaters won't force the hatch open to fully assess etc we are having to push pretty hard to even get his insurer to talk to us...

              Dealing with getting my Dr bills paid and some for a month or two to make sue I get full movement back (maybe $1k all up) is a similar thing. It's no wonder those accident chasing lawyers are making cash because so far I'm at 45+ pages of forms and reports...

                Not sure what to do but can I suggest you call them and say something like.

                Thanks for the quote for repairs to your car.
                I have a quote for $0 as the assessor could not identify any damage to my car.
                You have now sent through a formal document that indicated your car is unroadworthy. I would strongly advise you not to drive that car on the road as you will not be covered by insurance. I feel obliged to notify the police who will be interested in removing the number plates from your unroadworthy car.

                Would you like to pursue this claim any further?
