I recall seeing something years ago about drink driving. Basically they tested different people abilities before drinking and after drinking, a few more drinks and more driving, and so on. It showed how the different levels can effect people different, they had a seasoned drinker who drove fine after blowing more than double the limit.

Your body adapts, its the reason why I've seen big hitter piss heads knock over a bottle of scotch in 45 minutes with only a minimal degradation to their motor skills.
Feed them 5 beers and send them down the road and they are no worse than when sober.

To not even be charged with some type of manslaughter charge is a tragedy in itself.
