    Loan Car Fiasco - Help me

    Dear PF.

    Recently I've had our car run into and it's off for repairs.
    There's a novel behind that but I won't waste your time with the details.

    The issue is this.
    As part of my coverage I am entitled a loan car. That's been all fine and there's no issues.
    However the other night that_guy and I were coming back from Fyshwick (industrial estate) no worries.

    Anyway we heard a small clunk then 500m down the road the hire car (near new Toyota Corolla hybrid) warning lights came on telling me it had over heated.

    We rang the number to contact Hertz who the rental comes through. We were told specifically to not open the bonnet and to not leave the car till the uber picked us up.

    Did this and cleared out the car from all my belongings. We did notice a pool of coolant on the floor so figured it must have busted a hose or something.

    Nothing further it went onto a tilt tray and was hauled off somewhere.

    The kicker is the wife gets a phone call saying we are liable for the damage I've caused on the car.
    They've told her that I've intentionally damaged it and twisted the radiator and they're demanding we pay the damages.

    My wifes asked them for multiple pictures of the damage, any incident reports from their repairer or quotes to have it fixed.

    I talked to my insurance provider and they're pretty good about it all but even contacting Hertz was a shit fight. I was on the phone with insurance and 3/4 of that was on the line to Hertz waiting for someone to take their call.

    I am concerned that I'll be up for some exuberant amount of money and unsure where to go.
    Insurance said the worst case scenario is I pay the excess on my insurance to cover it (my insurance clicks over to cover me in it) which is still a fucking shit.

    Does anyone know if I have a leg to stand on? Is there any legal things I should do before telling them to get fucked?

    The worst part of all this is I didn't take any pictures or evidence that the car wasn't damaged before it was loaded on to the truck. Only thing I can think of is trying to get something out of the towie but I doubt they'll help if anything.

    This is obviously assuming all your AUX outputs are doing something. Ie idle control, and the other does water spray, and the other updates your Instagram automatically etc.

    How are they saying you damaged it? They can't just say 'you did it' without some sort of exploitation with how "you've" done it. Things break on cars all the time, this sounds like standard hire car company BS to try and get the customer to pay for everything

      In my experience generally this means the manufacturer has knocked back warranty and the rental company look to blame someone as they don't like paying for maintenance.

      unless you did something stupid it shouldn't be your fault??

      did it do good rollbacks?

        Amy asked them for a full explanation on what's been damaged and how they come the conclusion I've done it. So far no evidence has been provided. The most she got out of them is "The radiator has been twisted and that's on you".

        I can't see how driving for maybe an hour could lead the thing to over heat causing the radiator to twist? My Gemi used to seem to kill alloy radiators but I don't think I've ever seen one twist before?

        I told the the chick from the insurance straight up. I'm an honest guy if I intentionally damaged it I'd have put a claim in OR gotten it fixed before the time it was returned. If it was a simple as a radiator I'd have swapped it out in the driveway and they'd have no idea.
        I know they say check the car before it leaves but who the fuck checks everything mechanical?
        I'll just pull my portable hoist out to check while you are here? She agree'd.

        But no I wasn't doing anything dumb in it at all to pretty much avoid any further issues. It was actually a nice car to drive.
        (This is like 5:30ish in peak hour IN THE COLD to...)

          My experience with Hertz insurance hire cars is that they get you where it hurts.

          Mother in law (nopics) had to pay full excess for a tiny little chip of clear coat on a door that was probably there before she got it. Cunts.

            I'm pretty sure you can't twist a radiator without a substantial impact that would fuck the rad support panel, or an epically ham-fisted and botched radiator removal attempt.

              Well this is it. She's gotten on the fb group and someone said that to. I would suggest it may have been wacked before and they've used 2nd hand bits? or just not unfucked it.

              I think honestly I would have done maybe 5-600ks maybe in it no more than 1000 in the 3 weeks we've had it. I feel like now it was a ticking time bomb waiting for some poor sap to end up with it. I.e. me.

              I expressed concern that the replacement would do the same now to lol

                Lawyer up - these clowns prey on people not exploring their rights and / or couldn't be bothered fighting the fight.

                I had an issue with Europcar a few years ago and they were absolutely full of shit. There are lots of stories on the net as to how they blame people for damage that didn't even happen.

                    I'm in the game and the dodgyness of the industry is long gone.
                    The accc put everyone on notice, went through every damage claim in the past. There were over a million claims and something like only 100 were found to be suspect.
                    They will make an example of anyone who does the wrong thing.
                    Europcar got massive fines in Tassie and the guy lost his franchise.

                    I guarantee you there would be 100x more dodgy customers trying to get out of shit than damage being attributed to the wrong person.

                    Hertz takes photos of the hire car before you receive it, you should have got them emailed to you.

                    I'm not associated with fyshwick but if you pm me the rego I might be able to look into it.

                        To date ive asked for all evidence, reports and photos and hertz havnt sent me a thing. Only a phone call demanding money. Its impossible to twist a radiator when theres no damage to the outside of the vehicle. Rego is 1PQ 4OY

                          You'd think being new it'd be sweet? I dunno see what Sturmovik can dig up I suppose?

                          I would think if we hit something it'd be pretty dam big. This sounded like that_guys foot hitting the plastic on the door trim. You'd think that the radiator sat higher than the road height but? Like I;d say if we hit a possum for example there would be more damage than just the radiator. There was no visible damage on the front of the car after we had visually looked at it (we needed to confirm the rego with Hertz twice) we'd have noticed it.

                          They've got like a plastic looking plate underneath anyway don't they? Visually it looked like there was one and I'd say that should protect anything from flying up and wacking it? If that was the case you'd expect some damaged further along to?

                          mad_cow he's in the market for a new car so we were at car yards looking around.

                              exact opposite of me, i had a car that someone had tried to jimmy the front door open with a screwdriver, they didn't charge me.
                              had a ding picked up in a work carpark bigger than a 20c peice, still didn't charge me for it
                              neither of them were my fault, but did happen while i had the car
