A customer like that shouldn't even have to ask for a loan car, it should almost be forced upon him.

                  Short story....
this is about an insurance company not a car manufacturer but its still applicable.
I was in an accident, other persons fault, i got their name, license no, car rego but not their address, so GIO stuffed me around for 9 months. I made all kinds of threats, but the only one that worked was when i told them i had been discussing it with the media, i got apporval for the repairs the same day.

Media is a last resort in most cases, and if you threaten to do it, you better follow thru..

I have been in a position to take on a Manufacturer who sold me a "lemon". I took them on and they replaced my car after 6 mths. They had to tool up to make the same car again as it was finished it's limited production run and I wanted the same number as my original one.

It too had similar problems and I then had my money refunded and I gave them the car back after a few more months.

Media is a last resort -

I gave Chris some names at BMW to contact as we have lots of dealings with them, but first step for me would be Dealer Principal to get some real answers, and a loan car - the DP probably doesn't even know the problems are there - the Service people don't give a rats arse how many cars you have bought - The Dealer Principal certainly does...

We often get problems with new cars that arrive here that we insure, they have a slight accident and no-one in the country knows how to repair certain bits etc, so they send out techs from overseas and train up some people to look after it...

I hate people who threaten Consumer Affairs or Dept of Fair Trading over the first problem they ever encounter. I just tell them to go ahead, and in the meantime, do they want their gear fixed..... everytime I've had to deal with Consumer Affairs type people, I've simply explained the situation, what we've offered and how we are not denying any warranty etc to the customer. They never call back because we're in the right :D

A gearbox should not break in the first 3 months. But it can, and sometimes it will. The dealership should definitely not be telling porkies in regards to the repair time. If they can't fix it in a week, then say so. They should be giving a loan car, and if they don't have one, then they can give you a secondhandy they can rip off the used car lot. It wouldn't happen to be a Bavarian dealership on the North side of Sydney by any chance?

sheesh, i bet this bloke has been pussy footing about..
if i had a M5 and it broke, had been 3 months, i'd get a loan car. it's not a matter of "will they offer me one" it's a matter of "fucking give me one or i'll kick up such a stink you'll be sorry"

it's to be expected, you spend $250k, you expect platinum service.

my dad bought the 2006 325i.. windows weren't tinted like he requested, they gave him a 330ci for 2 days while the windows got tinted, and the car came back with the windows tinted, free leather treatment, a free BMW F1 polo, and free BMW F1 hat

Nafe sadly sometimes it takes that much, i had trouble with a ISP i went thru the correct channels in order to get it fixed, but it never happened. so i had to take it further so i threatened to go the TIO Still no result so i went to the TIO, problem was fixed once they were contacted by the TIO.

Even thou its not car related i went thru all the paths i had to before threating to go a step further, they called my bluff but i wasnt and went the step further.

Im not sure about BMW but i know for a fact the a Holden DP has to be approved by Holden.

Nafe - the issue is more with the run around he is getting and the fact that after 4 weeks they dont seem to be any closer to actually resolving the problem. He would probably be satisfied with "Sorry be we have no f***ing idea whats wrong, but Helmut is on his way from Munich and knows how to fix it".

getting the run around might be normal for telstra, commonwealth bank and <$1,000 laptops... I'd be ballastic if my Hyundai was given the same treatment.

                              ps. I don't have a Hyundai.
