    Id write back with a nice letter telling them in short, to fuck off and die..

    As pointed out, the trading post, is a generic term, and I somehow don't think telescum have the ability to say who can and can't use common english words..

    the most likely reason they're doing this, is they went to google, and typed in "trading post" and checked to see what came up, then decided to send people letters telling them to stop using the words..

    seriously, id write back and tell them to do the worst they can <double check with a lawyer first>

    you'd think the wankers have better things to do, like build a working phone network, than chase people of a forum sub section..

          It would be good to milk a few letters and threats out of them - not to make you feel any better, but to cost Telstra a lot more in consideration, settling, perusal etc.

          Ustasa, the people that write these letters are just doing what their told, and it's probably an easy way to make billable hours for the week. I imagine each letter would cost Telstra approx $300 - $400 and any reply would just be costing them more.

          ps - don't forget to write "without prejudice save as to costs" on top of all your letters.

            Well that's just it. These schmucks are retained by Tel$tra to protect their IP. So they'll pick up on any little nuance just to be able to justify to Tel$tra that they are doing (however poorly) their job. Then they'll charge like a wounded bull for it.

              Before everyone has a go at Telstra (Trading Post), this basically has to do with trademark protection/enforcement. Let a little guy go here and there establishes a precident and the Trademark owner is seen to not be defending their trademark. Then when a not small entity starts using the words "Trading Post" they are in a weaker position. I think they really wouldn't give a toss about your forum but they have to be seen to be defending the trademark.

              Anyone in the legal profession that can confirm this? Or just say I'm talking out of my arse?

                    Copy what oldenholden said in a letter to the lawyers and ask for a please explain as to how a common term is trademarked and copyrighted and if it is please show proof at no cost to yourself.

                    Most likely you won't get out of changing the name, but just for kicks you might as well give Telstra an even bigger bill from their lawyers.

                        guess they're getting scared their business model is outdated and pretty flawed so have to attempt to scare everybody else doing similar.

                        When you can list an ad on carsales or the like for $10 flat rate .. I'd be running scared too..

                        They'll be gone in 10 years unless they pull their head out of their ass.

                            Looks like they have trademark on it (Trade Mark : 809123 - TRADING POST)

                            Unfortunately I'm sure you have less money than them to fight it but I'd be surprised if you didn't stand a chance of overturning it due to it being a coloquial term. But in the end who's going to bother.

                              But, change the name and don't try and fuck around with a company like Sensis/Telstra...
