I've seen a few forums that have had to change the name from Trading Post, I gues they think that free internet sales on forums are taking away from their busines.

        What MZ21 said.

I love how everyone thinks lawyers are fucked up until they need one.

Same with journos actually, they're all full of shit until someone has an issue with a big company and everyone says "Go to the media!"

Anyway, that's my whinge for the day.

Thanks for all the support guys, I was fairly confident you'd be on my side!

Kev is right, the site has been around for around seven years and has always used the name 'trading post' for our for sale/wanted section. I will change it, because there's no way I'm going to try and fight it, but I'll certainly try and stir some trouble in the mean time! :p

I'll keep you updated on the progress.

Interesting thread.....I would change it. They have the registration for "Trading Post" in the precise area that you are using it (advertising via the Internet) and as someone touched on above, if they are NOT proactive in stopping any and all use, then they risk the trade mark becoming generic and then loosing the rights to it (you can get a generic name trade marked if you can show distinctiveness acquired through use over time - a big hurdle but can be done, and likely done by TP in this instance) - if they did not, then they would end up in a hoover, elevator situation (they used to be trade marks) - also why Google do the same thing.

Much as I was laughing at the slagging off of the lawyers, they are certainly not stupid so I would walk away - FWIW, don't pick a name anyway shape or form similar to TP - choose something else original and voila, you can trade mark it!

this is where they convert their expenses in setting up a copyright into cash. as posted, at least give them some tongue in cheek without getting caught out.

they are about to layoff lotsa staff so the signs are they are looking to squeeze every dollar from their investments; if you can call their strategic move into TP an 'investment'

If i read what kev said correctly, telsrat only have the trademark for TRADING POST not Trading Post.

IF SO, then you 'might' be able to get away with using the first caps version, OR a lowercase version, as they're held ny two different companies....

and also, what a wank... good luck

Change it to the "Piper Alderman For Sale Section" then when they hit you with a legal notice, change it back to "Trading Post", then repeat.
