Anyone been bankrupt before?

    From memory i think (when it happened to me) you have to make a submission stating that there's no way you can pay the debt. With what happened in my case I was on apprentice wages (take home roughly $250/wk plus my football earnings which was a "win and get paid contract" in a season we got hammered!) and I could only just afford living with payments I could make being a low percentage of the interest on my tax bill.

    Essentially I would still be paying it if I chose to try.

    I do think it has been made a lot harder now to go bankrupt... A lot of people where just using it as an easy out, and a lot of rorting cunts used it to cover their ass too...

      I did it to pay off vet bills amongst may other debts inc utilities personal loan (not with a bank).

      I believe there is a provision to claim due to sever financial hardship which at a guess I would say old mate would qualify for.

          You are right, but the difficult thing is proving the 'sever' part......like bankruptcy some people have used cashing in their super to their advantedge....it is supposed to be paid to the lender but sometimes there are fuck ups and the customer gets the money spends it like he/she has won lotto and they cant apply again for 12 months.

          As a conductor don't you have access to financial counselling & other forms of counselling that could assist you further ?

            OH yeah and FYI Pat. I effectively earn $24k pa take home, less than half what you get. I drive to work everyday in an S15 (and still spend less money on petrol than you even though I get 18L/100km?), rent my flat close to the city, eat whatever I want, when I want. Go out most weekends and still have money left over to save.

            So it's kind of beyond me how you can't manage to pay back more? If I were on your money I'd pay back at least $500 a week and that's with me driving an expensive as fuck car (1/4 of my pay goes to my car ffs)...

              It's great to see some sensible advice but lets be honest here (and no offence to old mate pathamilton) - someone who gets into massive personal debt bying stuff they can't afford to pay for and also manages to land in some bizzare kiddy porn situation due to leaving internet and utilities in their name at a place they no longer live in (to be honest I find all this hard to believe re the feds and the computer and the dodgy kids stuff) is not going to magically read a forum, get some much needed advice and miraculalously turn around their life from one of irresponsibility to sensibility.

              It all just boils down to this - your life is basically the sum of your decisions. Want a better life? Start making some better decisions.

                Um someone's not reading my posts properly. Guess i wasnt that clear either but its not the ex who has a problem with me, she would love it if i could see my son again and be the taxi-dad i used to be.
                It was the cops who decided that due to the computer being used for some kind of bizarre chat that since they couldnt pin it on anyone that they would at least prevent me from seeing my kid.
                Hence 3 yr AVO asked for and gotten by JIRT team in Kogarah.
                Ex is signing a family order consent form to say she has no problem with me seeing him but they will still probably want to look into why the AVO was put in place. Interview cops etc.
                This is going to cost a bomb, so will need all the disposable cash i can get.

                admitted a few times now its 99% my fault im in the hole I am in re debt and that there is a lot of sucking up and getting on with it i can do to fix that.

                A trustee taking everything i make over 900 bucks (with 1 dependant) for 3 years and leaving me with a shitty credit rating is not exactly an easy way out either.

                Tempting but not a soft option by any means, going to try and tighten the belt for now. Didnt say i was keeping the car just that its going to be the hardest thing to let go of, time to man up though and admit its gotta happen.
                Pity i cant use my super lol, no way im going on the dole just to qualify for that!

                As for free financial advice for conductors, not looked into it but wont hurt to call the union and ask

                  not being sarcastic here thats fucking awesome you can live the dream and make it all work on such a basic income. Im sure your only a few years off that going up and up, problem with guards wages is while nice to start with they are pretty static other than the odd adjustment for inflation.
                  With the changes im making due to advice received here i should be able to throw that 500 a week in. if you can make it work on such a low income then i gotta be able to do it, cheers for the ray of hope

                    Wages won't go up and up. Once I get a job (I'm a PhD student) sure, moneys would effectively triple but job security is shit (1 year contracts) and I eventually want to own property so it's not like I can go around spending money like crazy. Besides, I want to work overseas and I'd earn like $US30k in the states for the next 10 years.

                    You on the other hand are in a perfect position to repay money. Stable job and big yearly expenses you can easily do without.

                      It's all been said on here already, but I just have to reiterate, sell the car! You have no need for it. I've sold 3 of my precious cars on separate occasions in the past when I needed money for more important things such as property. Only 3 months ago I sold my $45k Golf GTI for a small loss as I simply wasn't using it enough to justify the on going costs and depreciation (catch the bus to the city each day).

                      To be honest it was like a weight lifted off my shoulders, I was by no means struggling or in the hole you are in but it felt good to know that the car was not sitting idle in the garage all the time wasting money.

                      It's clear you can do this, reduce the internet plan if possible, get rid of the mobile phone and go back to the work phone, buy cheaper food, drink water, rent out the garage or car space, use the free public transport, ask for extra shifts at work. It's not impossible.

                      Lastly I don't know how or why you haven't cut up the last credit card, get a VISA debit card and learn to love it. I've never had a credit card and I survived just fine. If you don't have the money in your account after repayments you can't afford it, sit at home and watch TV or use your 150 gb internet for pr0n or whatever.

                      It's clear the car is the biggest waste of money in your life, sell it, pay back a big chunk of the debt and celebrate the fact you won't have any of the on going running costs associated with it anymore.
